الشروط والأحكام العامة لاستخدام تطبيق CityLink

تمهيد

يُعد استخدام تطبيق CityLink الإلكتروني بمثابة قبول كامل وصريح لكافة الشروط والأحكام الواردة أدناه، ويُرجى عدم استخدام التطبيق في حال عدم الموافقة على أي من هذه الشروط.

1. التعريفات

لأغراض هذه الشروط، يكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها ما لم يقتضِ السياق غير ذلك:

التطبيق: تطبيق CityLink الإلكتروني سواء عبر الهاتف المحمول أو الموقع الإلكتروني.
الشركة: شركة سيتي لينك لأنظمة التحول الرقمي والمدن الذكية.
المستخدم: أي شخص طبيعي يستخدم التطبيق لعرض أو سداد الفواتير.
الخدمات: خدمة عرض الفواتير المستحقة وسدادها إلكترونيًا.
الفواتير: المبالغ المالية المستحقة على المستخدم والصادرة من الجهة الإدارية أو الجهة الخدمية المختصة.
عملية الدفع: كل معاملة إلكترونية مستقلة يتم تنفيذها عبر التطبيق باستخدام بطاقة ائتمان.

2. نطاق استخدام التطبيق

يقتصر استخدام التطبيق على:

الاطلاع على الفواتير الخاصة بالمستخدم فقط.
سداد الفواتير المستحقة من خلال بطاقات الائتمان.

لا يتيح التطبيق:

تعديل أو إنشاء أو إلغاء الفواتير.
سداد فواتير تخص مستخدمين آخرين.

لا يُسمح باستخدام التطبيق لأي أغراض غير قانونية أو مخالفة للقوانين السارية.

3. التسجيل وصحة البيانات

يلتزم المستخدم بإدخال بيانات صحيحة ودقيقة عند استخدام التطبيق.
يتحمل المستخدم وحده المسؤولية الكاملة عن أي أخطاء ناتجة عن إدخال بيانات غير صحيحة.
يحق للشركة تعليق أو إيقاف استخدام التطبيق في حال إساءة الاستخدام أو الاشتباه في نشاط غير مشروع.

4. وسائل الدفع الإلكتروني

تقتصر وسيلة الدفع داخل التطبيق على بطاقات الائتمان فقط.
تتم جميع عمليات الدفع عبر بوابات دفع إلكترونية مرخصة ومعتمدة داخل جمهورية مصر العربية.
يقر المستخدم بأن بطاقة الائتمان المستخدمة:
- سارية المفعول.
- مملوكة له أو مصرح له قانونًا باستخدامها.
لا تقوم الشركة بحفظ أو تخزين أي بيانات خاصة ببطاقات الائتمان.

5. رسوم الخدمة وعمليات الدفع

يوافق المستخدم صراحةً على تحمّل رسوم خدمة مقابل استخدام خدمة الدفع الإلكتروني.
تشمل رسوم الخدمة ما يلي:
- نسبة واحد ونصف في المائة (1.5%) من إجمالي قيمة عملية الدفع.
- رسوم ثابتة قدرها خمسة جنيهات مصرية عن كل عملية دفع واحدة.
يتم احتساب الرسوم تلقائيًا وإضافتها إلى إجمالي المبلغ قبل إتمام عملية الدفع.
جميع الرسوم غير قابلة للاسترداد بعد إتمام عملية الدفع بنجاح.

6. تأكيد عمليات السداد

بعد إتمام عملية الدفع بنجاح، يحصل المستخدم على:

إشعار فوري داخل التطبيق.
رقم مرجعي خاص بالمعاملة.

يُعد هذا الإشعار إثباتًا مبدئيًا على السداد لحين التسوية النهائية مع الجهة المستفيدة.

7. سياسة عدم الاسترداد والنزاعات

لا يجوز للمستخدم المطالبة باسترداد أي مبالغ تم سدادها عبر التطبيق.
في حال وجود نزاع بشأن أي عملية دفع:
- يتم الرجوع إلى سجلات بوابة الدفع الإلكتروني.
- أو التواصل مع الجهة المصدرة للفواتير.
لا تتحمل الشركة مسؤولية:
- رفض العملية من قبل البنك.
- تأخير التسوية البنكية.
- الأعطال الفنية الخارجة عن إرادتها.

8. حدود المسؤولية

لا تتحمل الشركة أي مسؤولية عن:
- أي خسائر غير مباشرة أو تبعية.
- أي أعطال تقنية أو انقطاع في الخدمة ناتج عن الإنترنت أو أنظمة البنوك.
تقتصر مسؤولية الشركة — إن وجدت — على حدود قيمة الخدمة محل النزاع فقط.

9. حماية البيانات والخصوصية

تلتزم الشركة بحماية بيانات المستخدم وفقًا لأحكام قانون حماية البيانات الشخصية المصري رقم 151 لسنة 2020، ويتم استخدام البيانات فقط للأغراض المرتبطة بتقديم الخدمات.

10. التعديلات على الشروط

تحتفظ الشركة بحق تعديل هذه الشروط والأحكام في أي وقت.
يتم إخطار المستخدم بالتعديلات عبر التطبيق أو الموقع الإلكتروني.
يُعد استمرار استخدام التطبيق بعد التعديل قبولًا صريحًا بالشروط المعدلة.

11. القانون الواجب التطبيق والاختصاص القضائي

تخضع هذه الشروط وتُفسر وفقًا لقوانين جمهورية مصر العربية، وتختص محاكم القاهرة وحدها بنظر أي نزاع ينشأ عنها.

CityLink – Terms & Conditions

Preamble

Using the CityLink electronic application constitutes full and explicit acceptance of all the Terms and Conditions stated herein. Users who do not agree to any of these terms must refrain from using the application.

1. Definitions

For the purposes of these Terms and Conditions, the following words and expressions shall have the meanings assigned to them below unless the context otherwise requires:

Application: The CityLink electronic application, whether mobile or web-based.
Company: City Link for Digital Transformation & Smart Cities Systems.
User: Any natural person using the application to view or pay bills.
Services: Viewing due bills and paying them electronically.
Bills: Financial amounts due from the user as issued by the authorized administrative or service entity.
Payment Transaction: Any independent electronic transaction executed through the application using a credit card.

2. Scope of Application Use

The use of the application is strictly limited to:

Viewing the user's own bills only.
Paying due bills using credit cards.

The application does not allow:

Creating, modifying, or cancelling bills.
Paying bills on behalf of other users.

The application may not be used for any illegal or unlawful purposes.

3. Registration and Data Accuracy

The user shall provide accurate and correct information when using the application.
The user bears full responsibility for any errors resulting from incorrect data entry.
The Company reserves the right to suspend or restrict access to the application in cases of misuse or suspected unlawful activity.

4. Electronic Payment Methods

Payment through the application is strictly limited to credit cards only.
All payments are processed through licensed and authorized electronic payment gateways within the Arab Republic of Egypt.
The user confirms that the credit card used is:
- Valid and active.
- Owned by the user or legally authorized for use.
The Company does not store or retain any credit card information.

5. Service Fees and Payment Transactions

The user expressly agrees to bear service fees for using the electronic payment service.
Service fees include:
- One and a half percent (1.5%) of the total payment transaction amount, and
- A fixed fee of five Egyptian Pounds (EGP 5) for each single payment transaction.
Fees are calculated automatically and added to the total payable amount prior to completing the payment.
All fees are non-refundable once the payment transaction is successfully completed.

6. Payment Confirmation

Upon successful completion of a payment transaction, the user shall receive:

An in-application confirmation notification.
A unique transaction reference number.

Such confirmation shall constitute preliminary proof of payment pending final settlement with the beneficiary entity.

7. No Refund Policy and Disputes

The user shall not be entitled to request a refund for any successfully completed payment transaction.
In the event of any dispute regarding a payment transaction:
- Reference shall be made to the electronic payment gateway records, or
- The issuing billing entity shall be contacted.
The Company shall not be liable for:
- Bank transaction rejections.
- Banking settlement delays.
- Technical failures beyond its control.

8. Limitation of Liability

The Company shall not be liable for:
- Any indirect or consequential losses.
- Service interruptions caused by internet or banking system failures.
Any liability borne by the Company, if any, shall be strictly limited to the value of the disputed service only.

9. Data Protection and Privacy

The Company is committed to protecting user data in accordance with Egyptian Personal Data Protection Law No. 151 of 2020, and data shall be used solely for service-related purposes.

10. Amendments to the Terms

The Company reserves the right to amend these Terms and Conditions at any time.
Users shall be notified of amendments through the application or website.
Continued use of the application after amendments shall constitute explicit acceptance of the updated terms.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, and the courts of Cairo shall have exclusive jurisdiction over any disputes arising herefrom.
